Susy's Chihuahuas Sales Contract / Health Guarantee

We, the undersigned parties, have read and agree to all the terms of this agreement and acknowledge it as legal and binding.

This puppy has been administered, as indicated in the medical record, the following vaccinations and de-worming before leaving our home/kennel.  

We accept Postal Money Orders, Cash, and Paypal only. Please make money orders payable to Susana Nunez.

The amount of two hundred dollars of the deposit made towards the purchase of a puppy is NON-REFUNDABLE. Full payment of the balance due must be paid on or before the date on which the pup reaches eight (8) weeks of age. Failure to do so forfeits the Buyer’s deposit and reservation of the puppy. Refund of deposit will only be available under the following circumstances:

(1)       Should the reserved puppy be found by our veterinarian  to have a life threatening abnormality (see Health Guarantee below for definition of life threatening and non-life threatening abnormalities) before placement  of the puppy with the Buyer of before shipment of the puppy to the Buyer, or (2) should the puppy die before placement of the puppy to the Buyer and/or before shipment of the puppy to the Buyer, the Buyer may request a refund of deposit or apply the deposit to another available puppy.

The parties of this contract agree that the dog identified on page one (1) shall carry the “Susy’s” prefix to its name for “Susy’s Chihuahuas”. The “Susy’s” prefix will be added to the AKC papers by the breeder before the papers are transferred to the new owner(s). It is the buyer’s responsibility to insure that the “Susy’s” prefix is part of the dog’s registered name. This is enforceable by the AKC per this contract.

FEEDING YOUR NEW PUPPY 

Our puppies/dogs eat Diamond Naturals Chicken & Rice. Although bringing your new puppy home is the most exciting day for you, it is not exciting for the puppy. The puppy is leaving everything that it has known, including its dam and littermates. Expect your puppy to go through a period of stress. Signs of stress could include crying, refusal to eat, or loose stools. Please give the puppy some time to adjust. Please keep the puppy’s new environment quiet and calm the first few days. This will make the adjustment easier for the puppy and hasten bonding between you and your new puppy. Treats are of whole or pressed rawhide and are great for keeping teeth free of plaque. We suggest that toys be of soft nylon or cloth-like materials that are machine washable, instead of latex rubber that can be punctured or shredded.

VACCINATIONS AND DEWORMINGS

We have provided the following vaccination and de-worming schedule. At first, it is best to avoid taking your puppy to the park, pet store, walks, etc. Your puppy is not fully immunized against diseases such as Parvo until the complete series of vaccinations is administered. Usually this is completed by 16 weeks of age. Parvo, for example, is highly contagious and can be carried in and transferred on peoples shoes. Your puppy could easily contract Parvo if taken to places where other dogs frequent. We STRONGLY SUGGEST that you follow through the vaccination and de-worming schedule recommended by your veterinarian. Negligence could result in sickness or death of your puppy. The guarantee does not cover parasites, external or internal, Giardia, Hypoglycemia, Hepatitis, Parvo, Kennel Cough, Distemper, Rabies, Coccidiosis, or Corona. The proper immunizations have been administered and the Seller cannot be held responsible if the puppy is exposed to contagious parasites or diseases after leaving our kennel. The Buyer is responsible for ALL veterinary costs/expenses once the puppy has left the Seller’s home.

PUPPY GUARANTEE – ONE YEAR

The Seller gives the Buyer one (1) year health guarantee against LIFE THREATENING abnormalities, such as a heart murmur or liver shunt which are believed to be hereditary. If any abnormality that could be life threatening is found the Seller must be notified immediately. If the Buyer does not notify the Seller immediately of any life-threatening abnormality as diagnosed by a licensed veterinarian the Buyer shall not have recourse against the Seller. If the puppy is found to have a life-threatening congenital or hereditary defect, the Buyer must take the puppy for a second opinion by a different licensed veterinarian who is not associated with or in practice with the original examining veterinarian. The Buyer must provide the Seller with a written statement from both veterinarians before a replacement puppy will be considered. Both veterinarians must find that the puppy has the same defect and that said defect is life threatening. CASH REFUNDS ARE NEVER GIVEN. If the puppy dies before the expiration of the one (1) year period the Buyer must have the puppy autopsied. The Buyer must provide a statement from the veterinarian along with the autopsy results before a replacement puppy will be considered. The Buyer is responsible for all costs incurred, with all veterinarians, for any and all veterinarian visits once the Buyer has taken possession of the puppy. If the puppy is found to have a life-threatening defect and is living, the puppy must be returned to the Seller, including all paperwork and AKC papers, before a replacement puppy will be considered or issued. The Buyer is responsible for all costs incurred with returning the puppy, including shipping costs. The Seller will have 12 months to replace the puppy with another puppy of equal value and quality.

This guarantee DOES NOT COVER THE FOLLOWING:

These are minor flaws that in some cases can be corrected by a veterinarian; others are common traits of the breed.

UNEVEN BITE: This is not life-threatening. As the puppy matures, a periodically check of its bite must be made, as sometimes puppy teeth will remain and must be removed as adult teeth come in.

EARS NOT STANDING: This is not life threatening.

COAT COLOR: The coat color can change as the puppy matures.

COAT LENTGH: We try to accurately determine what coat length the puppy will have at maturity, but in rare instances, our determination may be incorrect. There is no guarantee on coat length.

SIZE: We try to accurately estimate the size the puppy will be at maturity, but in some instances our determination may be incorrect. There is no guarantee on size at maturity.

TRACHEA: This is often called a reverse sneeze and is not life threatening.

HERNIAS: There is no guarantee on hernias of any category.

TESTICLES: The seller does not guarantee the presence of both testicles nor does the Seller guarantee that both testicles will descend. If only one (1) testicle descends or none descends the Seller cannot be held responsible. Sometimes at eight (8) weeks and even twelve (12) weeks of age, the puppy is too young to determine if both testicles are present. Testicles can descend as late as six (6) months of age.

ABILITY TO WHELP OR SIRE A LITTER: The Seller does not guarantee the ability of a puppy to sire a litter or to whelp a litter.

PATELLAR LUXATION: There is no guarantee regarding patellar luxation and the Seller shall not be responsible if the puppy, at any age during its lifetime, develops patellar luxation.

MOLERA: The molera is often called a “soft spot”. By the age of 1-1 ½ years only 16% of moleras are closed. About 50% of moleras never close. This is a common Chihuahua trait and is not life threatening.

HYPOGLYCEMIA: Often referred to as “Sugar Drops”. Chihuahuas have a small fat reserve around their liver making them prone to “Sugar Drops”. The smaller the Chihuahua, the higher the risk will be that the Chihuahua will have this condition. This is a risk that has been explained to the Buyer and the Buyer, upon signing this contract, agrees to accept the costs along with the risk of hypoglycemia. The parents of this puppy do not have hypoglycemia and this is not an inherited disorder. Special instructions are provided below on how to identify symptoms of hypoglycemia. The Seller does not guarantee that your puppy will never develop symptoms of hypoglycemia.

PARASITES, EXTERNAL OR INTERNAL: The Seller is not responsible for parasites, either external or internal. The Seller has administered all of the preventions that are recommended by our veterinarian. The Seller is not responsible for what the puppy is exposed to after leaving our home/kennel, as parasites are extremely contagious and can be contracted after leaving the Seller.

GIARDIA, HEPATITIS, PARVO, KENNEL COUGH, DISTEMPER, RABIES, COCCIDIOSIS, AND CORONA: The Seller is not responsible if the puppy contracts and/or develops Giardia, Hepatitis, Parvo, Kennel Cough, Distemper, Rabies, Coccidiosis, or Corona. The Seller has administered the proper vaccinations for this puppy according to its age and shall not be responsible for what the puppy could have been exposed to after leaving the Seller’s home/kennel. These are extremely contagious and can be contracted after leaving the Seller. Coccidia and Hypoglycemia can be brought on by the stress of going to a new home.

HYPOGLYCEMIA INSTRUCTIONS

Puppies that are usually affected by Hypoglycemia are the toy breeds weighing (3) pounds and under. Hypoglycemia most frequently happens between the ages of six (6) weeks and six (6) months, although Hypoglycemia can occur at any age. Keep Nutri-Cal or Nutri-Stat on hand at all times in case of an emergency. Keep your puppy warm. Contact your Veterinarian immediately. Symptoms of low blood sugar are listed below:

Puppy is limp, puppy does not lift his head by itself very easily, lethargy, lack of coordination, staggering, stumbling, falling, slowed heart rate, body temperature drops, mouth is stiff and gums may become white.

It is the responsibility of the Buyer to assure proper care if such a condition should arise. The Buyer agrees that the Seller is NOT responsible should a sugar drop occur. The Buyer agrees to seek proper veterinary care, as well as to preventative measures, such as insuring that fresh food and water are ALWAYS available for your puppy.

To assure that our breeding stock does not have the conditions stated above, we have them examined regularly by a licensed veterinarian, but we can in no way guarantee that the conditions listed above will never occur during the lifetime of your Chihuahua. The Seller will not be held responsible in any way if any of these conditions should arise. The Buyer has read and understands this contract and has agreed to take full responsibility if any such condition arises at any time.

COMMON MISTAKES

Please keep this puppy indoors, providing access to a fenced in yard, and never chain or tie your puppy out. Provide adequate living quarters. Do not let the puppy live in a cage or crate. This puppy is sold with the understanding it will be properly socialized, live indoors and become a part of the family. The Buyer agrees to maintain a safe environment for the puppy. The puppy is to NEVER be placed in an animal shelter, rescue group, or sold to a research lab or similar facility. Your home is now the puppy’s loving FOREVER home.

This puppy is now the responsibility of the Buyer. If at any time, you do not want the puppy or cannot keep the puppy you may return it to the Seller. We gladly have a place in our home for any puppy that we have bred if circumstances arise that you cannot continue to keep the Chihuahua. Should the puppy be returned to the Seller, the veterinarian’s records and AKC registration papers must be surrendered along with the puppy to the Seller. This puppy shall NOT be sold for profit by the Buyer under any circumstances and is an offense to be prosecuted by law. The Buyer agrees that the Seller will NOT provide a refund when the puppy is returned to the Seller. Every effort will be made to place the Chihuahua in another home or the Chihuahua will remain with the Seller.

SHIPPING

The Seller is in no way responsible for the death or injury of the puppy or loss of the puppy during transport. The Seller agrees to insure the puppy for the purchase price amount or up to the highest amount that can be insured if the purchase price exceeds the maximum amount the airline allows for insurance. The Buyer agrees to settle any dispute involving shipping and death/injury incurred by the puppy during shipping with the airline with which the puppy was shipped. The Seller shall NOT be held responsible for any death/injury incurred during shipping.

NO OTHER WARRANTIES OR GUARANTEES, NEITHER EXPRESSED NOR IMPLIED, ARE MADE UNDER THIS CONTRACT EXCEPT AS STATED ABOVE.

Having read and accepted all provisions of this agreement and guarantee the Buyer has agreed to the above terms by signing and dating below, including Buyer’s address and telephone number(s).
